1. Agreement

These Terms of Service govern your use of gunsairacing.com and any purchase you make from us. By using this site or placing an order you agree to these terms. This site is operated by Gunsai Racing, 1311 S Shamrock Ave, Monrovia, CA 91016 ("we", "us", "Gunsai Racing").

2. Eligibility

You must be at least 18 years old and able to form a binding contract to place an order.

3. Products and availability

Product information, including descriptions, specifications, images and fitment data, is supplied by manufacturers and distributors. We work to keep it accurate but do not warrant that it is error-free or complete. Inventory shown on the site reflects our supplier's stock at last synchronization and may change. We reserve the right to limit quantities and to discontinue any product at any time.

4. Pricing and errors

Prices are in U.S. dollars and may change without notice. If a product is listed at an incorrect price or with incorrect information due to an error, we may cancel or refuse any order placed at that price, whether or not the order has been confirmed and your payment method charged. If we cancel we will issue a full refund.

5. Order acceptance

Your order is an offer to buy. We may accept or decline any order for any lawful reason, including suspected fraud, pricing error or product unavailability. Acceptance occurs when we ship.

6. Shipping and risk of loss

Shipping terms are described in our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier.

7. Returns

Returns are governed by our Return and Refund Policy, which is incorporated into these terms.

8. Intended use, fitment and installation

Many products we sell are intended for off-road, competition or track use only and may not be legal for use on public roads. It is your responsibility to know and comply with all federal, state and local laws, including emissions regulations, applicable to your vehicle and its use. Products that alter emissions systems may not be legal for sale or use in California or other jurisdictions.

You are solely responsible for the correct selection, installation, tuning and use of any product purchased. Performance parts can affect vehicle safety, reliability, drivability and emissions compliance. We strongly recommend professional installation. Gunsai Racing is not responsible for installation costs, tuning costs, labor, downtime, vehicle damage or any consequential loss.

9. Warranties

Products carry only the warranty offered by the manufacturer, if any. To the maximum extent permitted by law, Gunsai Racing disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to any product or these terms will not exceed the amount you paid for the product at issue. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, personal injury or property damage, arising from the use or misuse of any product.

11. Indemnity

You agree to indemnify and hold harmless Gunsai Racing and its officers, employees and agents from any claim arising out of your use, installation, resale or misuse of any product, or your violation of these terms or of any law.

12. Intellectual property

All content on this site, including the Gunsai Racing name, logo, photography and original text, is our property or used under license and may not be copied or used without written permission. Manufacturer names, logos and trademarks belong to their respective owners and are used for identification purposes only.

13. Prohibited use

You may not use this site to scrape or harvest data, interfere with its operation, resell products in violation of manufacturer sales policies, or for any unlawful purpose.

14. Governing law and disputes

These terms are governed by the laws of the State of California without regard to conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to that jurisdiction.

15. Changes

We may update these terms at any time. The version posted at the time of your order governs that order.
